Agreement to these terms
These terms apply when you visit, create an account for, purchase, or use DNA Layer, including its website, personalised guidance, saved results, and downloadable artefacts. By using the service, you agree to these terms and our privacy policy.
If you do not agree, do not use DNA Layer. You must be at least 18 and legally able to enter into this agreement. If you use the service for an organisation, you confirm that you are authorised to bind it.
What DNA Layer provides
DNA Layer is a technology service that analyses supported information from a DNA file and combines it with curated scientific evidence to create personalised educational guidance. Features, supported file formats, evidence coverage, and presentation may change as the product and science develop.
Genetic research evolves and individual findings may be uncertain, incomplete, or reinterpreted. Results can vary because of file quality, genotyping platform, ancestry representation, evidence limits, and other factors outside our control.
Not medical care or emergency support
DNA Layer provides general educational information. It is not a healthcare provider, diagnostic laboratory, genetic counsellor, or emergency service. Using it does not create a clinician-patient relationship, and its content is not a diagnosis, prescription, or substitute for professional medical advice.
Do not start, stop, or change medication, supplements, treatment, diet, or medical care based only on DNA Layer. Discuss health decisions and any concerning result with a qualified clinician who can consider your history, symptoms, examinations, and validated testing.
Do not use DNA Layer for an emergency. Contact your local emergency services immediately if you believe you or someone else is in danger or needs urgent medical care.
Accounts and security
You must provide accurate information and keep your account and sign-in methods secure. You are responsible for activity performed through your account unless caused by our failure to use reasonable security measures.
Tell us promptly at contact@dnalayer.ai if you suspect unauthorised access. We may require identity verification before restoring access, disclosing data, or completing a rights request.
Your DNA file and content
You keep ownership of the DNA file and other information you provide. You grant DNA Layer a limited, worldwide licence to host, process, reproduce, and transform that content only as needed to provide, secure, support, and improve the service in accordance with our privacy policy.
You may upload only your own data or data you are legally authorised to use. You confirm that your upload and instructions do not violate another person’s privacy, confidentiality, intellectual property, or other rights.
Automated and AI-assisted output
Some explanations are drafted with automated and AI-assisted systems, then constrained by evidence and safety rules. These systems can produce content that is inaccurate, outdated, incomplete, or unsuitable for your circumstances.
You are responsible for how you use or share generated output. Review important information, follow cited sources where provided, and seek professional advice before making health decisions.
Prices, payment, and cancellation
Prices, included features, taxes, and any recurring or one-time payment terms are shown before checkout. You authorise our payment provider to charge the selected payment method for the amount shown. You must be authorised to use that method and keep billing information accurate.
Refund and cancellation rights are described at checkout and remain subject to any mandatory consumer rights that apply where you live. If a service cannot be delivered, contact us so we can investigate and provide the remedy required by applicable law.
Acceptable use
You may use DNA Layer only for lawful personal purposes. You must not:
- upload data you have no right to use, impersonate another person, or misrepresent consent;
- attempt to bypass access, payment, security, usage, or geographic controls;
- probe, scrape, reverse engineer, overload, disrupt, or introduce harmful code into the service, except where law expressly permits;
- use the service or its output to discriminate, make decisions about another person without a lawful basis, or cause harm; or
- resell, sublicense, or commercially exploit the service without our written permission.
DNA Layer content and intellectual property
DNA Layer and its licensors own the service, software, design, branding, evidence organisation, and other content we provide, excluding your content and third-party material. Subject to these terms, we give you a limited, personal, non-exclusive, non-transferable, revocable right to use the service.
You may download and use your personalised artefacts for your own non-commercial purposes. Scientific publications, databases, and other third-party materials remain subject to their own rights and terms.
Third-party services and links
DNA Layer relies on third-party infrastructure and may link to research, healthcare, payment, or other external services. Their terms and privacy practices apply to your direct use of them. We do not control third-party content or guarantee that an external service will always be available, accurate, or secure.
Changes, availability, and termination
We may update, add, remove, suspend, or discontinue features to maintain security, comply with law, improve DNA Layer, or respond to operational needs. We will give reasonable notice when a material change adversely affects a paid service, where practicable and required by law.
You may stop using DNA Layer at any time and may request account deletion. We may restrict or terminate access if you materially breach these terms, create risk for users or the service, fail to pay amounts due, or if law requires it. Provisions that by their nature should survive termination will continue to apply.
Disclaimers
To the fullest extent permitted by law, DNA Layer is provided on an “as available” basis. We do not promise that every DNA file will be compatible, that the service will be uninterrupted or error-free, or that every output will be complete, current, or fit for a particular purpose. Nothing in these terms excludes warranties or rights that cannot lawfully be excluded.
Limits on liability
Nothing in these terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that law does not allow us to limit.
Subject to that sentence, DNA Layer is not liable for indirect or consequential loss, loss of profit, opportunity, goodwill, or data, or harm resulting from medical decisions made without professional advice. For paid services, our total liability arising from the service will not exceed the greater of the amount you paid to DNA Layer in the 12 months before the event giving rise to the claim or €100, except where mandatory law provides a different remedy.
Governing law and disputes
These terms are governed by the laws of the Netherlands. The courts of Amsterdam have jurisdiction, subject to any mandatory right you have as a consumer to bring a claim in another court or rely on the consumer law of your country of residence.
Before starting formal proceedings, please contact us and give us a reasonable opportunity to resolve the issue. This does not prevent either party from seeking urgent relief or using a statutory consumer complaints process.
Changes to these terms
We may revise these terms as DNA Layer changes. We will post the revised terms and update the date above. If a change materially affects an existing paid service, we will provide additional notice where required. Continuing to use the service after the effective date means you accept the revised terms.
